The Protection of Personal Information Act 4 of 2013 or POPIA, as it is commonly referred to, effective from 1 July 2021, is a law that aims to protect an individual’s rights to privacy by regulating the manner in which Personal Information is collected, processed, shared, and stored both by public and private bodies. POPIA will therefore regulate how South African businesses handle personal information.

The purpose of the Promotion of Access to Information Act (PAIA) is to promote a culture of transparency, accountability and good governance both in the private and public sectors. The PAIA Act grants a Requester access to records of a private body, if the record is required for the exercise to protection of any rights. Requests in terms of the PAIA Act shall be made in accordance with the prescribed procedures, at the rates provided.
